Once an appeal is triggered, the merchant must confirm that appropriate consent was obtained. If consent cannot be established, or if the person depicted can demonstrate that the consent is void under applicable law, the merchant must remove the content immediately. The policy must also include verbiage that states that, in case of a disagreement, the disagreement will be resolved by a neutral body, at the merchant’s expense.
